Appellant Burr was convicted after trial by jury of rape, a class A felony, Ind. Code Â§ 35-42-4-1 (Burns 1985 Repl.), and burglary, a class B felony, Ind. Code Â§ 35-43-2-1 (Burns 1985 Repl.). He was sentenced to concurrent terms of imprisonment of 30 Years and ten years. This Court affirmed Burrs convictions on direct appeal. Burr v. State (1980), 273 Ind. 280, 403 N.E.2d 343.
